Terms & Conditions

These terms govern your use of PoolAxis, a pool service management platform operated by Virtuality Ltd (New Zealand). By creating an account or using the service, you agree to these terms.

1. The service

PoolAxis provides a web portal for pool service operators and a mobile application for field technicians. Features include job scheduling, route optimisation, chemical readings, treatment recommendations, and automated reporting to pool owners.

PoolAxis is provided exclusively for use in the course of a trade or business. The service is not intended for consumers acquiring it for personal, domestic, or household purposes. Where applicable, the Consumer Guarantees Act 1993 (NZ) is excluded to the maximum extent permitted by law for customers acquiring the service in trade. For customers in Australia acquiring the service in the course of a business, liability under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) is limited to resupply of the service or the cost of having the service supplied again, to the maximum extent permitted by law.

2. Free trial

New accounts include a 14-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial period, you must subscribe to continue using the service. Accounts that are not converted to a paid subscription are suspended and data is retained for 30 days before deletion.

3. Subscriptions and billing

Subscriptions are billed monthly or annually in advance via Stripe. Prices are displayed in New Zealand dollars (NZD) exclusive of GST. NZ customers will have 15% GST added at checkout. Australian customers pay the listed price in Australian dollars (AUD) with no GST applied. You may cancel your subscription at any time; access continues until the end of the current billing period. We do not provide refunds for partial periods. Payment data is processed by Stripe under Stripe's own terms and privacy policy and is not stored by Virtuality Ltd.

4. Chemical treatment recommendations

PoolAxis calculates treatment recommendations using the Langelier Saturation Index (LSI) — a standard water chemistry formula widely used in the pool and aquatics industry. The LSI evaluates whether pool water is corrosive, balanced, or scale-forming by combining six measured parameters:

  • pH
  • Water temperature
  • Total alkalinity
  • Calcium hardness
  • Cyanuric acid (stabiliser)
  • Total dissolved solids (where provided)

From the LSI score and the pool's recorded volume in litres, the system calculates the variance from target ranges and suggests a chemical dose in the appropriate unit (mL, L, g, or kg) for each out-of-range parameter.

Important: The LSI calculation addresses water balance only — specifically the corrosive or scale-forming tendency of pool water. It does not evaluate, recommend, or provide guidance on sanitiser levels (free chlorine, combined chlorine, total chlorine, bromine, or any other biocide). Sanitiser management remains entirely the responsibility of the operator and technician. A pool may display a balanced LSI score while having unsafe sanitiser levels. Operators must independently test and manage sanitiser concentrations in accordance with applicable health standards.

4.1 Limitations and disclaimer

Treatment recommendations are provided as a guide only. They are calculated entirely from the readings entered by the technician and the pool volume recorded in the system. The accuracy of any recommendation depends directly on the accuracy of the values entered.

Pool water chemistry is affected by factors that cannot be fully captured by algorithmic calculation, including but not limited to:

  • Bather load and frequency of use
  • Environmental contamination (leaves, rain, debris)
  • Equipment condition and calibration
  • Chemical interaction and carry-over from prior treatments
  • Pool surface type and age
  • Chemical application method, timing, and sequencing
  • Pool circulation state at the time of dosing
  • The condition, age, or integrity of pool surfaces and equipment

Operators and technicians must apply professional judgement when interpreting and acting on recommendations. PoolAxis treatment suggestions do not constitute professional pool service advice and must not be relied upon as a substitute for the qualified expertise of the operator or technician on site.

Virtuality Ltd accepts no liability for any water chemistry outcome, damage to pool equipment, pool surfaces, or plant life, or harm to persons arising from the use of or reliance on treatment recommendations generated by PoolAxis.

4.2 Software accuracy

While Virtuality Ltd takes reasonable care to ensure the accuracy of the LSI calculation engine, the software is provided "as is." Virtuality Ltd does not warrant that calculations will be free from error, that results will be accurate for any specific pool configuration, or that the system is fit for any particular purpose. No representation or warranty is made, express or implied, about the correctness of any treatment recommendation.

4.3 High-risk environments

PoolAxis is designed as a job management and decision-support tool for qualified pool service professionals operating on residential and commercial pools. It is not certified or approved as the primary means of chemical management for regulated public aquatic facilities, hydrotherapy pools, swim schools, or any facility where health authority standards require independent professional oversight. Operators using PoolAxis in such environments do so at their own risk and must ensure compliance with all applicable regulatory requirements independently of any recommendation generated by this service.

5. User responsibilities

You are responsible for:

  • The accuracy of all readings and data entered into the system.
  • Ensuring your team holds any licences or certifications required by law to perform pool servicing in your region.
  • Keeping account credentials secure and not sharing access with unauthorised parties.
  • Compliance with all applicable health and safety legislation, including the Health and Safety at Work Act 2015 (NZ) and equivalent legislation in your jurisdiction, when handling pool chemicals and operating pool facilities.
  • Compliance with all regulatory obligations related to pool operation in your region, including any regional health authority requirements applicable to the type of facility you service.

6. Acceptable use

You must not use PoolAxis to store false, fraudulent, or misleading pool records; attempt to reverse-engineer, copy, or replicate any part of the platform; use the service in a way that disrupts its operation for other users; or resell access to the platform without written permission from Virtuality Ltd.

7. Intellectual property

PoolAxis, including all software, algorithms (including the LSI calculation engine), user interface designs, and content, is owned by Virtuality Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the service during the term of your subscription. No ownership rights are transferred.

You retain ownership of all data you input into the system. You grant Virtuality Ltd a licence to store and process that data solely for the purpose of providing the service.

8. Availability

We aim to maintain high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for losses resulting from downtime outside our reasonable control.

9. Limitation of liability

To the maximum extent permitted by applicable law in your jurisdiction (New Zealand or Australia), Virtuality Ltd's total liability for any claim arising from your use of PoolAxis — whether in contract, tort, or otherwise — is limited to the subscription fees you paid in the three months immediately preceding the claim. We are not liable for indirect, consequential, or incidental losses of any kind.

9A. Indemnity

You agree to indemnify, defend, and hold harmless Virtuality Ltd and its directors, employees, and agents from and against any claims, losses, damages, costs (including legal costs on a solicitor-client basis), and liabilities arising from or related to: (a) your use of the service or any treatment recommendation generated by it; (b) data you enter into the system; (c) actions taken by you or your technicians in reliance on any recommendation; or (d) any third-party claim brought against Virtuality Ltd that arises from services you have provided to your clients using PoolAxis.

10. Termination

We may suspend or terminate your account if you breach these terms, fail to pay subscription fees, or use the service in a manner that causes harm to Virtuality Ltd or other users. You may terminate your account at any time through the settings panel.

11. Governing law

These terms are governed by the laws of New Zealand. Any disputes arising from or relating to these terms or the PoolAxis service shall be subject to the exclusive jurisdiction of the New Zealand courts. Nothing in this clause excludes any statutory rights you may have under the Australian Consumer Law that cannot be excluded or limited by contract.

12. Changes to these terms

We may update these terms from time to time. We will notify account holders by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms. The current version is always available at poolaxis.app/terms.

14. Privacy

Virtuality Ltd collects and processes personal information in connection with providing the service. Our Privacy Policy explains what information we collect, how we use it, and your rights under the Privacy Act 2020 (NZ). For users in Australia, personal information is also handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using PoolAxis, you agree to our Privacy Policy and confirm that you have obtained any consents required under applicable privacy law to provide us with personal information about your clients and technicians.

15. Force majeure

Virtuality Ltd is not liable for any delay or failure to perform its obligations under these terms to the extent caused by circumstances beyond its reasonable control, including but not limited to acts of God, internet or telecommunications failures, cyberattacks, government action, or third-party infrastructure outages.
